Individual Health Mandate
With healthcare reform all individuals are required
to purchase health insurance by 2014 or pay a tax penalty. The legality of the individual mandate, a major cornerstone of the healthcare law, is expected to be decided by the U.S. Supreme Court.
Georgia has partnered with 25 other states in an effort to repeal the healthcare act by declaring the individual mandate as unconstitutional. The U.S Appeals Court for the 11th Circuit, based in Georgia, ruled 2 to 1 that Congress exceeded it's authority by requiring all Americans to buy health insurance.
Georgia Health Exchange
Georgia is required to set up a health insurance exchange by 2014, as mandated in the health care reform bill. The federal government will set up exchanges for states that don't set up their own.
Goveror Nathan Deal, who opposes the federal healthcare overhaul, appointed a committee to
study whether Georgia should design it's own health exchange. It is reviewing who should run it, how to make the system financially stable, and it's impact on the Georgia health Insurance marketplace. A list of recommendations is due by December.
Healthcare Reform
The Affordable Care Act, passed in March of 2010, has had a significant impact on Georgia residents.
Positive changes - Young adults are allowed to stay on thier parent's plan until they turn 26 years old. Preventive healthcare services are now covered at 100% with no member out of pocket expenses.
Negative changes - Since children under 19 may no longer be denied coverage due to pre-existing health conditions, all Georgia insurance companies elected to no longer accept child only applications.
